The following General Terms and Conditions apply to all legal transactions with consumers and businesses involving

hereinafter referred to as “I” or “me”.

Legal transactions may be concluded in person, by post, by email or via the website.

These General Terms and Conditions apply exclusively. Any terms and conditions used by you that conflict with or deviate from these General Terms and Conditions will not be accepted unless I have expressly agreed to their application in writing or in text form.

I. Applicable Law

The law of the Federal Republic of Germany shall apply.

For the purposes of the following provisions, a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. A business is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.

The version of these General Terms and Conditions valid at the time of booking shall apply. The prices valid at the time of booking shall apply.

II. Subject Matter of the Contract

The contract may cover the following services:

  • Heilpraktiker services: consultations, blood draws, IV infusions
  • Ayurvedic constitution assessment, nutrition and lifestyle counselling
  • Ayurvedic massages and manual therapies
  • Online nutrition and lifestyle counselling
  • Retreats: taster retreats (2–3 hours), online retreats
  • Multi-day retreats (week-long retreats, 6 days)

III. Prices, Payment Terms, Due Dates and Retention of Title

1. Conclusion of the Contract

1.1 For bookings or purchases made verbally, by telephone, in writing, by email or via a messenger or booking service, the following applies:

(1) You contact me by telephone, email or via a messenger service.

(2) Offer: By making a booking, you submit a binding offer to enter into a contract with me.

(3) Acceptance: The contract between you and me is concluded when you receive my confirmation email.

(4) For retreats, a deposit of €150 is payable following confirmation. The remaining seminar fee must be transferred no later than 8 weeks before the seminar begins.

(5) The conclusion of the contract obliges both parties to fulfil their contractual obligations.

(6) If the participant does not make use of the agreed contractual service, the participant remains obliged to pay the agreed price.

(7) Payment can be made by bank transfer. You will receive an invoice from me by email. The full invoice amount is due immediately. Once your payment has been credited to my business account, you are entitled to the corresponding service.

Under the German small business regulation pursuant to Section 19 of the German VAT Act (UStG), I do not charge VAT.

2. Contract Term and Termination

(1) The duration of our contract depends on the service booked. As a rule, the contract ends automatically once both parties have fulfilled their obligations. This means that you have paid my full fee and I have provided the corresponding service.

(2) The right of either party to terminate the contract for good cause remains unaffected. I may terminate the contract for good cause in particular if you have fallen into arrears with payments more than twice, if you intentionally breach provisions of these General Terms and Conditions and/or have intentionally or negligently engaged in prohibited conduct, or if our relationship of trust has been permanently disrupted.

IV. Details of Services and Cancellation Policy

1. Location of Consultations, Massages, Workshops and Retreats

(1) Nutrition and lifestyle counselling is offered both online and in person. All other services are provided in person only.

(2) For online consultations, you are responsible, at your own expense and risk, for providing and ensuring internet access (hardware, telecommunications connections, etc.) and any other technical equipment and software required to use my online services, in particular a web browser and PDF software such as Acrobat Reader® and Zoom.

2. Scope of Services and Services Not Used

(1) The scope of the service is determined by the respective booking.

(2) If you do not make use of individual services, for example if you miss a class during a retreat, I reserve the right to charge the full fee nevertheless.

(3) If a service cannot take place, for example due to illness on my part, it will be rescheduled as soon as possible. If this is not possible, the fee for the outstanding appointment will be refunded.

(4) The scope of services for retreats includes the services listed on the website. The following are not included in the course fee: accommodation and meals (these are billed separately and directly by the retreat venue during the retreat), travel to and from the retreat, taxi, bus and train fares, drinks consumed outside the venue, and special requests relating to drinks and meals.

3. Cancellations

3.1 Cancellation of My 6-Day Retreats

(1) Once you have received my confirmation email, your participation is binding.

(2) You may cancel your participation up to 8 weeks before the retreat begins without any additional charge; the €150 deposit will be retained.

(3) If you cancel up to 28 days before the course begins, 50% of the total amount is payable. If you cancel 27 days or less before the course begins, the full amount is payable.

(4) Alternatively, you may transfer your place to another person before the course begins. There is no charge for this transfer.

(5) If you discontinue the course after it has begun, the full fee will be retained unless you provide a medical certificate.

(6) Cancellation must be made in text form.

(7) I reserve the right to release a place that has not been firmly confirmed to someone on the waiting list.

3.2 Cancellation of My Taster Retreats

(1) Once you have received my confirmation email, your participation is binding.

(2) Cancellation is not possible. If you do not attend or cancel your participation, the full participation fee will be retained.

(3) Alternatively, you may transfer your place to another person free of charge before the course begins.

(4) I reserve the right to release a place that has not been firmly confirmed to someone on the waiting list.

3.3 Cancellation of In-Person Consultations and Massages

(1) Once you have received my confirmation email, the appointment is binding.

(2) You may cancel the appointment free of charge up to 48 hours before it begins.

(3) If you cancel less than 48 hours before the appointment, the full amount is payable.

(4) Alternatively, you may transfer the appointment to another person before it begins.

3.4 Cancellation of Online Consultations

(1) Once you have received my confirmation email, your appointment is binding.

(2) You may cancel free of charge up to 24 hours before the appointment begins.

(3) If you cancel less than 24 hours before the appointment, the full amount is payable.

(4) Alternatively, you may transfer the appointment to another person before it begins.

(5) Cancellation must be made in text form.

(6) I reserve the right to release a place that has not been firmly confirmed to someone on the waiting list.

3.5 Cancellations by Carmen Schumacher

(1) I am entitled to cancel a retreat or workshop at short notice if fewer than six participants have registered.

(2) I am also entitled to cancel if the reasons are outside the organiser’s sphere of risk (for example, illness) and no replacement can be provided.

(3) In the cases described in (1) and (2), I will refund your participation fee or offer an alternative date.

(4) If you breach the contract by violating these General Terms and Conditions, I have the right to exclude you from courses. In this case, no costs will be refunded.

V. Special Provisions for Massages and Yoga Classes During Retreats

1. General Information and Liability for Massages

I conduct my massages and yoga classes to the best of my knowledge and ability. I accept no liability of any kind, including for any resulting consequences. I do not make medical diagnoses. If in doubt, please consult a doctor before participating.

By booking and paying, you confirm that you indemnify me against any liability for damage, whether property damage or personal injury, caused by you to third parties or to yourself. This also applies to my online services.

2. House Rules for Yoga Classes During Retreats

The yoga room may only be entered barefoot or wearing socks. Mats and other equipment will be provided by arrangement. You may bring your own yoga mat, blanket or other equipment.

Shoes, bags and outdoor clothing must remain in the cloakroom. Mobile phones must be switched off.

Any damage caused by you in the studio must be remedied by you.

By participating in my in-person yoga classes, you agree to the applicable hygiene policy and hygiene rules and undertake to comply with them.

If, despite a warning, you repeatedly violate generally accepted standards of conduct or the house rules, I am entitled to terminate the contract with immediate effect and ban you from the premises. The same applies in the event of intentional damage to property or for other good cause. Your obligation to pay the agreed fees until the earliest possible ordinary termination of the contract remains unaffected.

VI. Data Protection

In accordance with Article 13 of the General Data Protection Regulation (GDPR), users are informed that their personal data will be electronically stored and managed by me for processing purposes. The provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) will be observed.

The user agrees to the electronic use and processing of their personal data to this extent. Personal data may not be disclosed to other third parties without the specific consent of the person concerned.

I reserve the right to use photographs or videos taken at retreats or other events for promotional purposes on Facebook, Instagram, my website or flyers. You undertake to inform me immediately if you do not wish to appear publicly in photographs.

I recommend taking out travel cancellation insurance for retreats.
